RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY (“AGREEMENT”)
1.) In consideration of being permitted in any way in the INDOOR SPORTS* Activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions are unsafe, I will immediately discontinue further participation in the Activity.
2.) I fully understand that: (a) _INDOOR SPORTS*_ Activities involve risks of minor injuries and dangers of serious bodily injury, including permanent disability, paralysis, and death (“Risks”); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the “Releasees” named below; (c) there may be other risk and social and economic losses either not known to me or not readily foreseeable at this time; and that I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity.
3.) I hereby release, discharge, and covenant not to sue EAT Sports Foundation, INC nor the City of Martinez, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, or any sponsors, advertisers, and if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise, including negligent rescue operations and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

The following COVID-19 has been added to our existing waiver for EAT Sports Foundation, Inc.
You must agree to and follow its current rules as well as any future modified and/or amended Rules. Failure to adhere to these Rules, including the 6 feet social distancing rule will result in suspension of access privileges to EAT Sports Foundation, INC (EAT).
No person who is feeling ill, has a fever or exhibits any of the symptoms of COVID-19 should access the facilities. Based on currently available information and clinical expertise, individuals of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. Anyone who wishes to participate in EAT services should be familiar with the information set forth on the CDC website and should carefully consider whether it is advisable to come to EAT.

Access to EAT facilities shall be restricted for anyone who contracts the COVID-19 virus and may be restricted for individuals who came into contact with anyone with the COVID-19 virus until reinstated by the EAT in writing.
